Google Counter Claim – Personal Web Search
The EU recently announced what has quickly become known as the ‘Right-to-be-Forgotten’ Privacy ruling against Google. They must comply with an individuals request to remove ‘inadequate, irrelevant or no longer relevant personal data’.
In response, Google have set up a website and online form to manage requests and have also brought together a team of Internet experts to consider the ramifications of the decision. Now, there are any number of issues around this, not least the subjective nature of the conditions applied to the data. Google have said it would assess each request and balance “privacy rights of the individual with the public’s right to know and distribute information”.
And if you think that this was a limiting factor, then in recent days Google have stated that they will limit their support for the Ruling only to Domains WITHIN the EU! This means that is the source of the information and/or the server on which it is held is outside of the EU then Google will not take any action.
However, a bigger question remains: a single to request to Google, based on an individuals personal check on that one Search Provider will in all probability NOT discover every personal mention on the Internet – across multiple Search Providers, Forums, Blogs and Micro-Blogs – and all the other platforms that store and exchange data.
ECIJA Brand Watch can do this for you! Backed by a major Pan-European Law firm and utilising its proprietary search tools, we ensure the widest possible coverage to identify any potential ‘infringing’ mentions. Already subscribed to by many of the top businesses and high-profile individuals in Europe in respect of corporate Brand Protection and Reputation Management, ECIJA Brand Watch is now the ideal service for all individuals, providing a bespoke and cost-effective solution.
Based on names and terms supplied by the verified* client, ECIJA Brand Watch collate the search results and provide detailed reports back to the customer. If further action is required, then we will not only centrally manage the ‘requests for removal’ to the relevant ISP or Search Provider, but will also undertake any legal follow up on the clients behalf in respect of any mentions that are deemed to malign or be defamatory.
Available either as a ‘one-off’ search and report (price?) or as an ongoing, scheduled monitoring exercise, this service will not only identify personal data that an individual wants removed. Additionally, it may identify any incidences of Identity Theft, something unfortunately prevalent in today’s society.
ECIJA Brand Watch is available in Ireland only through O’Connor Swale Partners, the exclusive service distributor for Ireland and the UK.
